WEST PALM BEACH, Fla. — Drunken drivers beware: If you drink and drive, especially during the last weekend of February, the Palm Beach County Sheriff’s Office and other area law enforcement will be out for blood.
PBSO deputies plan to set up driving under the influence checkpoints. If they suspect a driver is under the influence, they’ll offer an on-the-spot Breathalyzer. If drivers refuse, deputies will ask to draw blood from their arms.
“I think that’s really personal and I think that if you deny a Breathalyzer and you say that you don’t want that, I think that’s outrageous if they take blood without your consent,” driver Courtney Liddle said.
Attorney David Olson said that “would only be lawful if a warrant is issued by a judge.”
That’s just what deputies plan to do. They’ll actually drive to a judge’s home for a signature and return to the checkpoint.
Olson said drawing blood from drivers is usually done in extreme cases like homicides and fatal collisions. Olson said he’s not sure a judge would actually sign a warrant. Read More

Moments before he was killed, Oscar Grant was punched in the face — but not by the BART officer who shot him.
A new cellphone video shows another BART officer punching Grant just before he was shot by BART Officer Johannes Mehserle, who was arrested on murder charges nearly two weeks ago.
The grainy video raises new questions about what role BART officers played in escalating the scene, which began when Grant was pulled off a San Fransisco Bay Area Rapid Transit Authority train on New Year’s Day. Six days letter, protests turned to riots in Oakland, Ca.
The officer who punched Grant in the face is the same officer who investigators say had his knee on Grant’s neck when the 22-year-old man was shot. Aside from Mehserle, no BART officers have been charged with wrongdoings.
“There’s no question in my mind that that’s vivid powerful evidence that he committed a vicious physical assualt, unprovoked on a citizen, for absolutely no reason,” said UC Hastings and Golden Gate law professor Peter Keane, who believes the officer should be fired and charged with assault. “That punch was totally unjustified… That officer is committing a crime.”
BART General Manager Dorothy Dugger has pledged to investigate the officer’s actions in the new video.
“I take this new allegation of police use of unreasonable force extremely seriously,” Dugger said in a prepared statement released Saturday night, KTVU.com reported. “I have directed (BART) Police Chief Gary Gee to conduct a rigorous internal affairs investigation into this officer’s actions.”
U.C. Berkeley law school professor Franklin Zimring said the district attorney must charge another BART officer with a crime. “If the district attorney is saying he’s not going to charge any officer except Mehserle in my opinion, he’s not doing his job,” Zimring says in the video below. “Police officers are not…immunized from the normal laws that govern when assault is criminal conduct.”
Alameda County District Attorney Tom Orloff would not comment on the possibility of charging a second BART police officer, KTVU.com reported.
Although unmentioned in the KTVU report, the video could potentially incriminate another BART officer. Since the female officer is shown in the video observing her colleague punching Grant, she would have been required to report what she saw to authorities.

A 43-year-old woman died this week after she collapsed in the jail’s psychiatric unit while in restraints, a spokesman for the Orleans Parish criminal sheriff’s office said Friday.
Cayne Miceli was arrested Sunday afternoon on municipal charges at Tulane Medical Center, where she had been treated for severe asthma, according to records and interviews with friends. After she was discharged, Miceli caused a “disturbance” and bit a Tulane University police officer, according to municipal court records.
She was booked with battery of a police officer, resisting arrest and disturbing the peace.
Miceli’s unusual death led friends to question both the medical treatment she received at the hospital and her subsequent experience at the jail.
“She turned to a system that she felt she could trust and this is what happened, ” said Steve Picou, a friend.
The Orleans Parish coroner’s office has not ruled on what caused Miceli’s death, which was reported to the office by University Hospital on Tuesday, said John Gagliano, the chief investigator. Gagliano said the office is awaiting toxicology reports, which will not be available for three weeks.
Friends described Miceli as a vivacious and gregarious woman who suffered from severe asthma and battled emotional and mental troubles. On Sunday, she went to Tulane Medical Center because she was having trouble breathing, friends said.
Officials with Tulane confirmed that she was treated for a “clinical concern, ” which the hospital would not specify, then discharged. At some point after she was discharged, Miceli caused a scene and bit a university officer just outside the waiting room, said Kim Graham, vice president of nursing. A young, black man in New Orleans is dead, slain by police officers on New Year’s Day, in an incident that has outraged a community and triggered protests over what family members are calling a “murder.”

The New Orleans man, 22-year-old Adolph Grimes III, traveled to his grandmother’s home near the French Quarter in order to celebrate New Year’s Eve with his fiance and their 17-month-old son. Three hours after arrival, around 3 a.m., he was found dead a block from the front door.
The Orleans Parish coroner said Grimes was shot 14 times, including 12 times in the back.
“This violence has to stop. My child’s death will not be meaningless. He did not die in vain,” said Grimes’ mother, Patricia Grimes.
Despite the fact that the seven officers involved in the incident have been reassigned, Superintendent Warren Riley has refused to answer “fundamental questions” about the shooting and maintains that Grimes fired upon his men first.
Several dozen people protested the New Orleans Police Department on Thursday morning to demand justice for Grimes’ death.
A mix of people walked paced in front of a police station carrying signs with slogans like “Down with the government” and shouting to passers-by “You could be next!”
A group of black ministers and advocates has called for the department to be purged of “trigger-happy” officers and the Grimes family’s attorney, Richard Jenkins is certain an investigation will show rogue cops and sloppy police work.
“I just think it was some bad officers who were out there and imposing their will on the community,” Jenkins said.
The shooting of Grimes by the NOPD marks the third high media incident of an officer or officers shooting a seemingly innocent black male thus far in 2009.
In Oakland, Calif, a BART officer shot a 22-year-old black male in the back on New Year’s Eve. The slaying was caught on multiple videos, all of which showed the man unarmed, subdued and helpless. The city is still struggling to contain the public’s reaction to what appears to be an execution.
Also, in Houston, a 23-year-old black male was shot in his own home’s driveway by a white police officer during the early hours of New Year’s Eve. According to published reports, the officer thought the man’s vehicle was stolen. An internal investigation is underway. While the department has denied allegations of racial profiling related to the shooting, no effort to explain why the officer suspected the vehicle to be stolen has been offered.
A protest over the fatal shooting by a BART police officer of an unarmed black man mushroomed into several hours of violence Wednesday night as demonstrators smashed storefronts and cars, set several cars ablaze and blocked streets in downtown Oakland.The roving mob expressed fury at police and frustration over society’s racial injustice.
OAKLAND, Calif. (Map, News) - Law enforcement officials urged patience while they investigated details surrounding the fatal New Year’s Day shooting of a 22-year-old man by a transit agency police officer.
Bay Area Rapid Transit Police Chief Gary Gee said on Sunday that the agency is “committed to completing an unbiased, thorough and detailed investigation” of the shooting death of Oscar Grant.
“This case is not even four days cold. We’re in the early stages of the investigation and we will do a very thorough job,” he said.

On Christmas day, four Washington, D.C. police officers were caught on tape stealing from Toys for Tots, a charity organization that collects toys for poor children. The United States Marines led the group’s toy collection drive.
Yvonne Smith, the Washington, D.C. police department’s outreach coordinator, pleaded with the media for less focus on the crooked officers.
This “starts off Christmas on a sour note, puts distance between the community and the police, and worst of all, tarnishes the image of the Department during a time when we are trying to build strong relationships to foster trust that ultimately helps us solve crimes,” she wrote in an e-mail to D.C.-area media.
Smith added that officers with her department had never done anything like this before — both distributing, and stealing, the charitable toys.
“Please don’t let the Christmas story of the day be about an investigation of officers who make up .001 percent of the department,” she concluded. “Many many many more members made outstanding contributions during this holiday season to make a difference in the lives of families who are struggling.”
“Anytime we are involved in programs that have potential for abuse we ask for the assistance of our Internal Affairs to maintain the integrity of our department and our members,” said Police Chief Cathy Lanier. “In this case, I am sad to say that monitoring has uncovered some questionable behavior of a few of our members.”
No arrests have been made, but D.C. police say the officers have been placed on paid suspension pending the investigation’s conclusion. Chief Lainer has vowed to see the officers “prosecuted to the full extent of the law.”

A naked man wandering around an apartment complex near Houston, Texas died after police shocked him with a taser four times.

Texas’ KPRC reports, “A naked man who banged on doors and cars at a north Harris County apartment complex died after he was shocked by a Taser gun, deputies told KPRC Local 2. An autopsy will determine the cause of the man’s death.”
The article continues, “The deputies involved have been put on administrative duty pending the outcome of investigations by the internal affairs and homicide divisions.”
The Houston Chronicle provides the police account of what transpired: “The resident ‘did not know who he was,’ said Lt. John Legg of the Sheriff’s Office. The first deputy arrived within minutes. ‘He was immediately confronted by the suspect, who ran toward his patrol car, opened the front passenger door and climbed in,’ Legg said.”
The Houston Chronicle story continues, “The deputy ordered the man out, but the man ignored his commands, yelling and flailing his arms, Legg said. ‘He was incoherent,’ the lieutenant said. ‘The deputy said his eyes appeared glassed over.’ The deputy’s Taser had little, if any, effect, officials said. After the man got out of the patrol car and pulled out the stun gun’s prongs, the deputy fired it again while struggling with the man, officials said. Another deputy arrived and ordered the naked man to back away, then used his Taser, investigators said.”
Earlier this year, members of the NYPD’s Emergency Unit tasered an emotionally disturbed man who was waving a fluorescent light while standing naked on a a building ledge, who then fell over ten feet to his death. The tasering “violated departmental guideline,” but no charges were brought against the officers involved. Not long after, the NYPD lieutenant who ordered the tasering committed suicide.
“Torturing and killing the mentally ill with tasers is becoming commonplace,” Hullabaloo’s Digby blogs,”There must be a better way.”
Tasers have have killed more than 400 people in the United States and Canada since 2001, according to a recent study.
“Taser International, based in Arizona, dismissed the study as flawed,” Nick Juliano recently reported for Raw Story. “The company maintains that its weapons are safe.”

‘ The Mendocio County Sheriff’s Office is guilty of contributing to the death of 54-year-old Maurizio Biasin by making no effort to save the drowning man, named and prevented his two 18-year-old sons, Dario and Andriano Biasini, from helping their dad as they insisted on waiting for the Coast Guard and a Sheriff’s boat.
The sons’ protests about the inaction of the authorities led to a struggle and cops tackled one while the other was restrained. The son who the cops tackled was then tasered as he lay on the floor and tasered a second time as he attempted to get up.

I have not been harping on the one aspect of America’s devolution into a police state that bothers me most: namely, the double standard by which a police officer can assault and even murder innocent people with legal impunity while the average Joe/Jane is crushed beneath a jackboot for the slightest perceived infraction. (BTW, I know some people think I should be more upset by other aspects…but that’s the chocolate v. vanilla debate.) What prompts me to write about the thugs who call themselves “peace officers” is my stumbling over four different stories in close succession.
Number 1: You won’t see this story in an episode of Cops!: A newlywed killed by police after he stepped outside his home to confront suspected burglars was shot in a case of mistaken identity, police said.
As I understand the article, the four kids suspected of burglary were eventually apprehended, questioned and not even arrested. In pursuit of the non-arrested (and presumably unarmed) kids, a 10-year-veteran of the police force — and, so, not a nervous or ‘cowboy’ newbie — considered the situation to constitute such a threat to public safety that he conducted a foot chase at night through a residential area with gun drawn, prepared to use deadly force. Which he did. For shooting an innocent, unarmed man twice through the chest, the officer in question has been placed on paid leave. What a great job! If I shot a man to death as part of my job as a writer, my ass would land and hard in a jail cell. This clown gets a paid vacation pending investigation by people who have a vested interest in finding the shooting to have been justified. I hope the woman he married the weekend before, who is expecting their first child, goes for justice rather than hush-money from the police department.
Number 2: WorldNetDaily reports: A Florida sheriff who trespassed and punched a driver in the face during a road-rage fight will not face criminal charges or lose his job – despite 13 citizen complaints filed against him in 12 years. The story: Jacksonville sheriff Sgt. Roderic Feacher claims Charles Rowe tried to run him off the road. (Sounds like someone passed him on the highway.) The off-duty Feacher pursued Rowe to his home and refused to leave the property when asked to do so. Rowe and a neighbor claim the officer began punching the man without provocation and choked him. However, the officer claims Rowe “belly-bumped” him, so he only threw one punch. According to the Florida Times Union, The State Attorney’s Office declined to file criminal charges, preferring to dock the thug 10-days pay.
Number 3: From the Atlanta Journal Constitution: A Texas man was arrested for letting girlfriend eat off his plate in a buffet restaurant. Dan Linscomb, 40, of Texas City, Texas, ate the buffet at the Iron Skillet restaurant in northwest Atlanta on Oct. 21. He admitted, an Atlanta police report said, that his girlfriend “ate a couple bites from his plate.” When he was charged for two $7 buffet meals, Linscomb refused to pay for one of them. He said that “there were no signs in the restaurant that said someone could not have some food off your plate,” the report said. The restaurant staff called police, who came to the restaurant on Donald Lee Hollowell Parkway and arrested Linscomb on a charge of theft of services. He was taken to Fulton County Jail.
Number 4: From WorldNetDaily: A Kansas resident is claiming he has been unfairly threatened by officers after he hand delivered a note to a police department administrator explaining why he will not vote for Obama He was charged with criminal trespass. Chapter 21, Section 3721(a) of Kansas law states criminal trespassing is when a “person enters or remains therein in defiance of an order not to enter or to leave such premises or property personally communicated to such person by the owner thereof or other authorized person.” But Garner said he was never aggressive, and he left Murphree’s property immediately. However, police still met him on his doorstep.
In other words, the police can beat and kill you (the average person) with legal impunity while you must walk on legal eggshells re: the most minor of civil infractions…which, arguably, may not arrestable offenses at all.

Officer To Protesting Reporter: ‘I Can Do Whatever I Want’
After a week of bloody shootings in the city of Newark, family members of the victims killed by gun violence marched in front of churches Sunday to ask the clergy for help.
The march ended, however, when a Newark police officer put a CBS 2 photographer in a choke hold, handcuffed him, and put him in the back of a police car.
What started as a peaceful demonstration by parents whose children were murdered on the streets of Newark turned violent.
“Put your hands behind your back,” the officer said. “He’s going with me. Put your hands behind your back.”
When CBS 2 HD’s reporter on the scene, Christine Sloan, protested and said he couldn’t arrest the cameraman, the officer said, “I can do whatever I want.”
The camera kept rolling, as the officer put CBS 2 photographer Jim Quodomine in the choke hold and placed him under arrest.
Witnesses took pictures of the incident and told CBS 2 HD what they saw.
“He went to put the camera down,” witness Latrice Smith said. “Before he had the opportunity to [do so], the police officer came and knocked it down.
“[The officer] just started grabbing him, putting handcuffs on him, grabbed him by the neck,” Smith said. “It was out of control for no reason.”

Two girls, ages 15 and 17, were attacked and arrested without warning by police while peacefully exercising their First Amendment Rights outside Sen. Obama’s hotel
Denver, CO – Two young girls were brutally attacked by police Wednesday evening without warning as they were chalking the sidewalk with pro-life messages outside the Westin Hotel, where Democratic Presidential Nominee Barack Obama is staying. The girls were knocked to the ground, kneed in the back, handcuffed, and painfully dragged away.
Arrested were Jayne White, 17, and Julia Giacopuzzi, age 15, who were participating in a peaceful demonstration that was part of A Prayer For Change events.
Also arrested was Rev. Patrick Mahoney of the Christian Defense Coalition.

According to Rev. Mahoney, the group had received permission to sidewalk chalk from Denver City Attorney David Fine and Denver Deputy Chief Police John Lamb and had been “sidewalk chalking” for six days prior to the arrests without incident.
They were later released and are now consulting attorneys in anticipation of possible legal action against the city.
“I am shocked at how cowardly these police officers behaved by attacking little girls without warning or provocation,” said Operation Rescue President Troy Newman. “Operation Rescue condemns this act of violence against peaceful demonstrators. There was absolutely no reason for it. Police officers are expected to control themselves better than that, and if they can’t they should not be in law enforcement. We call for immediate disciplinary action against the officers involved in the brutality incident involving Miss White and Miss Giacopuzzi.”
“Operation Rescue spent the week participating in A Prayer For Change with Rev. Mahoney and these young people, who have conducted themselves peacefully and appropriately at all times,” said Newman.

KY 3 News’ Sara Sheffield reports on an injured teen from Ozark, Missouri who was tasered up to 19 times by police.
Passing motorists called Ozark police out of concern for the teen as he walked along the busy overpass. When the police arrived, the young man was lying on the shoulder of the highway directly underneath the 30 foot high overpass with a broken back and foot.
Doctors believe 16-year-old Mace Hutchinson broke his back and heel after falling, as his injuries are consistent with such a fall. The boy’s family does not understand why police would have tasered the the teen 19 times after he was so seriously injured.
The teen’s father said that the use of the taser caused Mace to develop an elevated white blood cell count, leading to a fever that delayed the young man’s otherwise immediate surgery by two days.
Ozark Police Capt. Thomas Rousset attempted to explain why the taser was used:
“He refused to comply with the officers and so the officers had to deploy their Tasers in order to subdue him. He is making incoherent statements; he’s also making statements such as, ‘Shoot cops, kill cops,’ things like that. So there was cause for concern to the officers.”
Ozark police say that while there remains unanswered questions in the case, the reason for the use of the Taser is not one of them.

On the afternoon of June 7th long time activist Jim Stachowiak and friends were speaking out against the open border, pro – amnesty policies of public servant Senator Lindsey Graham during a campaign stop in Columbia, South Carolina.
Stachowiak’s small group was there to bring awareness to the crisis of illegal immigration and the intentional dismantling of U.S. sovereignty. Two issues you would expect a self-proclaimed pro family values conservative Republican and his supporters to defend. However on this day at the Sterling Garden Center these outspoken proponents of Constitutional rights would experience a contradiction in conservative values from Graham’s pro – amnesty supporters, as many attendees of the event took the time to hurl curse words popular with Vice President Dick Cheney toward the group as they walked into the campaign event.
One Graham supporter was so enraged witness’s claim she aimed her silver G35 Infinity at Stachowiak and his group. Fortunately Stachowiak was able to get his friend seen in the video out of the path of the vehicle but he was slightly grazed as the car passed. The vehicle bearing the plate “Airport Commission 3” parked nearby, the occupants an older man and women preceded into the Graham campaign event, when the victims asked the driver about her reckless behavior the elderly man with her paused only to say, “We don’t know what you are talking about.”
Concerned about safety, Stachowiak approached an officer with the Department of Homeland Security parked less than 100 feet away to request assistance. The officer claimed not to have seen the incident and would not take a report or investigate. Unable to get any help from the apathetic DHS officer Stachowiak called 911 only to wait one hour for two City of Columbia police officers to arrive who also showed little interest in investigating the minor hit and run.
Stachowiak is in the process of filing a report with the City of Columbia office of Internal Affairs concerning the day’s events. When asked about the dangers of speaking out at public events,
Stachowiak said, “One must be willing to stand up and take risk to protect the rights earned by those who made great sacrifice for our freedoms.”
Disgusting video footage of New York cops clubbing and arresting peaceful Tibetan protesters who were merely walking down the street has gone relatively ignored beyond Youtube.
While stories emerge out of China every day of police beating and killing Tibetan protesters in the streets, the same sort of behavior by cops in America tells its own story.
The footage was shot at a free Tibet peaceful assembly in New York on the 14th of March.
It shows the protestors holding flags and signs and peacefully walking down the street towards the UN building in the Turtle Bay neighborhood only to be accosted by police officers with batons.
One officer identified as “Delgado” is seen in the video pushing people as the group crosses the street.
Another officer, identified as “Serano” is caught threatening to kill two protesters as the cameraman passes. He later admits to the threat and apologizes for it.
As the group nears the UN building, cop cars and vans screech onto the sidewalks, cops pour out and begin to beat the protesters with clubs as UN security guards observe without becoming involved.
A non uniformed officer, who seems to be directing the entire operation, then orders the cameraman to step back and move away.
“Look at these cops, clubbing people in front of the UN, unbelievable, protesting to free Tibet, cops clubbing people in their legs on the sidewalk, in front of the UN in America, unbelievable, this is not China.” the American cameraman announces in disbelief.
The officer identified as Serano then forces the cameraman away from the melee, telling him to shut the camera off and that he will not talk to him because he may be a reporter.
Several officers then follow the cameraman asking him about his recording of the incident.

Another Meaningless Taser Death: Police Use Of Stun Guns Out Of Control Confused? Distressed? Need Help? Get tasered
The latest taser incident to be captured on film again highlights how fast our society is sleepwalking into a brutal police state where it is the norm for cops to react with extreme physical force and even torture towards anyone who acts out of the ordinary in any way whatsoever.
The video, released Wednesday, shows the brutal tasering and consequent death of Polish immigrant Robert Dziekanski last month at Vancouver airport.
Captured by a member of public, the footage shows the moments before police arrived and murdered Dziekanski by tasering him three or four times.
The film quite clearly reveals that Mr Dziekanski is suffering some sort of anxiety attack in the airport as he is breathing very heavily, sweating profusely and appears to be attempting to barricade himself in an empty area separated by a glass cordon. Clearly the barricade he fashions is not going to stop anyone getting through and appears to be more a cry for help.
Dziekanski at first seems to respond to passers by who attempt to calm him down but he clearly cannot understand what they are saying and becomes more distressed. After throwing a wooden table at the glass cordon and knocking a computer to the floor, the police arrive and within seconds taser Dziekanski sending him flailing to the ground screaming in agony.
The police then surround him and as the officers yell at Dziekanski to stop moving, which is impossible when 50,000 volts of electricity are moving through your body, a voice can be heard yelling “hit him again, hit him again.” The four large officers then jump on top of him, restraining his arms and sitting on his head. One officer appears to strike Dziekanski in the head with a baton.
Eventually Dziekanski stops moving and dies.
Is this in any way justifiable whatsoever?
The video also contradicts the officers’ report which states that the man they encountered was out of control. Police also said even after he was tasered once, he remained combative. But the video shows that after the first shot, Dziekanski fell to the ground and was writhing in agony.
An investigation is ongoing and the official cause of death has not been made public.
The fact that police immediately reach for tasers now in any delicate situation, even a non threatening one, speaks volumes about the society we now live in.
In another disgusting case reported today a man who slipped into a diabetic coma on the top deck of a bus in Leeds, England has described how he was used for electric stun gun “target practice” after he “failed to respond to instructions” and police “mistook him for a suicide bomber”.
Tasers are supposed to be the last response before lethal action, in the last year over 300 people have died in admitted cases in the US alone from being tasered. Every week we post stories of old women, children and disabled people being shot with tasers. The weapons are even being used in schools.
If you electrify any person, they stand a good chance of being killed, even more so if they are a child or an old person, and even more so if you do it three or four times before having a 200 plus pound man sit on the head of the victim.
The heart of the issue is that this was another act of wanton police brutality and torture by means of tasering.
The police are now trained that “pain compliance,” a euphemism for torture, is acceptable in apprehending anyone even if that person poses no physical danger.
In many cases, cops will taser someone even if they offer no resistance whatsoever, simply for the sick enjoyment of the power trip as the victim begs and pleads not to be tortured.
Consider the recent case of UCLA student Mostafa Tabatabainejad (video below) , who was stunned over and over again for refusing to show his ID at a campus library.

Tabatabainejad agreed to leave and was on his way out of the building before cops tasered him and then proceeded to order him to get back on his feet just so they could shock him over and over again as he cried and moaned for them to stop.
Consider also the case of Andrew Meyer, a University of Florida student who was grabbed by cops and tazed after he asked John Kerry a question at a public Q&A.

Police now use the taser as if it is a pair of handcuffs or pepper spray. Consider also the case of a man in Portland who was tasered by police for filming them conducting a warrantless search when in pursuit of a felon running through a neighbour’s property. The police came onto the property in search of someone else and ended up tasering the man that lived there!
What is just as concerning as the volume of cases of taser incidents being caught on camera is the reaction of a mindless selection of society, brainwashed by the media, that enjoy watching the videos online and like to see thuggish police inflict unnecessary pain, suffering and death. The incidents are so commonplace now that onlookers call for tazings when they perceive someone to have “stepped out of line”.
The bottom line is that taser use is being abused by police all over the country as cops are trained that torture is a perfectly acceptable response to somebody who acts out of the ordinary, asks the wrong question or refuses to show their papers
